Partner Visa – Allegation of Contrived Marriage

Our client W. Zou and her partner sought our assistance in replying to a letter of adverse information from the Department of Immigration and Border Protection regarding her Partner visa application. As a result of an investigation conducted by the Department, it was alleged that our client’s marriage was contrived and that our client had arranged to pay the sponsor $30,000 for a permanent residence visa. The investigation involved physical on-site visits to the couple’s home and telephone interviews. The evidence collected led the Department to believe that the couple was not in a genuine relationship.

 

We prepared comprehensive submissions to the Department which responded in detail to each allegation that was made against the couple’s relationship. Our submissions were strategically prepared in that we only responded to issues that were relevant to the couple’s visa application, while taking the approach of ‘no comment’ on issues that were clearly irrelevant to the legislative requirements of the Partner visa application. We worked timelessly with our client in collecting supporting documents that proved the authenticity and genuineness of the relationship between our client and her sponsor.

 

In the final outcome of the case, the Department was ultimately satisfied that the relationship was genuine and our client was granted a Partner visa.
