Skilled Independent Visa – Proper Assessment Process

 

We successfully assisted our client M. Gurung in this case in applying for a subclass 885 Skilled Independent visa. After submitting the application, the Department of Immigration and Border Protection requested for our client to provide a list of further supporting documents to assist the Department in reaching a final decision. Among the information requested was our client’s PAYG summaries for the year 2010 in order to satisfy the 12 months work experience component of the visa application.

Australian Citizenship – General Residence Requirement

 

In this case, our client Y. Vedernikova engaged us to assist her in applying for an Australian citizenship by conferral. However, our client had been previously informed by another law firm that she was ineligible because she did not satisfy the general residence requirement of the application. The general residence component requires the applicant to be present in Australia in the 4 years prior to the date of application lodgement, and that the total period of any absence does not exceed 12 months. This presented a difficulty to our client as she had recently travelled and lived in Singapore for 3 years due to her husband being temporarily relocated for work.

Orphan Relative Visa – Inconsistent Information Provided

 

We successfully assisted our client J. Liang in this case to navigate through a complex subclass 117 Orphan Relative Visa application. After submitting the initial application, the Department conducted investigations and obtained inconsistent information in relation to our client. In telephone interviews conducted by the Department, the sponsor informed the Department that the applicant’s mother passed away one week after giving birth. This was inconsistent with the documents that had already been submitted, which showed that the mother passed away almost two months after the applicant’s date of birth.

The Department requested for additional documents to confirm the authenticity of Ms Liang’s application. Among all the information requested, there was a request for the original cremation certificate of the client’s deceased father, despite the fact that the official notarised death certificate had already been provided.

Visitor Visa – Multiple Visa Refusal History

 

Our client Y. Fu sought our assistance in this case in applying for a subclass 600 Visitor visa for the purpose of attending her daughter’s graduation ceremony in Australia. While preparing the submission, we promptly noted that Ms Fu’s history of multiple visa refusals may be an adverse factor in the Department of Immigration and Border Protection’s final decision. Ms Fu’s previous visa records showed that within the period of three years, five separate visa applications had been rejected by the Department. This complexity placed a significant burden on the current case and gave it low prospects of success.
